LIMIT OF LIABILITY: In the unlikely event that your Photographer is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of your PHOTOGRAPHER, your PHOTOGRAPHER will return all payments, save for the non-refundable retainer fee/ down payment, received for the EVENT(S). In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond your PHOTOGRAPHER’s control, including but not limited to camera, hard drive, or equipment malfunction, your PHOTOGRAPHER liability is limited to the return of all payments, save for the non-refundable retainer down payment, received for the EVENT(S). COLLABORATIONS ON CREATIVE AND PASSION PROJECTS: All collaborations and creative passion projects are subject to their own terms and conditions and the above mentioned non-refundable retainer fee/ down payment and payment schedule do not apply. For collaboration on creative and passion projects, it is important for the CLIENT to be aware of what it takes for your PHOTOGRAPHER to collaborate. There are fixed expenses, variable expenses, auxiliary expenses and a unique experience. Some examples of the expenses that cannot be waved are: The costs for storage of your produced work, the cost for the web hosting and costs associated with your CLIENT page, Insurance for the equipment used to create your work, Rental for the equipment used to create your work, Trinidad and Tobago Corporation Tax for operating the IntrovertlyBubbly Creative in Trinidad and Tobago, Petrol and Travel expenses, An assistant who sometimes serves as a second shooter and the sourcing and acquiring props. While your PHOTOGRAPHER has agreed to donate her time and energy to your passion project the above costs are difficult to wave and are not typically absorbed by your PHOTOGRAPHER unless sponsors are available for the project. As a result, a minimum, based on the above a contribution, of $1800.00 TTD is required to cover the know costs for any project. Your PHOTOGRAPHER’s time and effort in creating this body of work for your project is complimentary. Your PHOTOGRAPHER commits to a minimum of 5 hours towards your project; this covers a two-hour shooting session and 3 hours of post processing and administration time. This fee a total of $4200 TTD for 5 hours shall be waved from your session. However the aforementioned $1800.00 TTD is a non-refundable fee/ payment to cover the above unavoidable expenses and is due at the start of your Session. The CLIENT will receive an email notification with a link where the CLIENT can view, share and download the photos. The CLIENT’S photos shall be available to download and save via dropbox or similar online platform for a week. Afterwards, they shall only be accessible, at a retrieval fee, via our archival records. So to avoid any additional charges the CLIENT is to be sure to download images within this period. Typical delivery schedule offers delivery of images one (3) weeks from shooting date. By selecting YES, the CLIENT understands and agrees to the above clause regarding the images taken by your Photographer at your session and contribution towards the completion of your project. *
